Cerebral Palsy

Cerebral palsy (CP) is a group of disorders that affect an individuals’ ability to move, maintain balance and posture. CP is the most common motor disability in early childhood. Cerebral Palsy occurs due to an anomalous brain development or due to damages to the developing brain that affects a person’s ability to control his or her muscles.

The early warning signs of CP vary from person to person. An individual with severe CP may need to use special equipment to be able to walk, or might not be able to walk at all resulting in the need for lifelong care. A person with mild CP, on the other hand, might walk a little clumsily, but may not require any special assistance. CP does not get worse over time, though the exact symptoms can change over the individual’s lifetime.

Those individuals with Cerebral Palsy usually have problems with physical movement and posture. Many also have related conditions such as seizures, problems with vision, intellectual disability, hearing or speech impediment; they may also experience changes in the spine (such as scoliosis) or joint problems.

Cerebral Palsy and Medical Negligence

Birth injury cases are exceedingly complex. Not only due to the legal complications that can be involved, but also due to the very stressful and emotional experience the parents and family have to endure.

A child can suffer from Cerebral Palsy as a result of medical error on the part of medical staff. Once we can determine that the error was a result of negligence and the injuries to the infant could have been avoided there may be a claim for clinical negligence.

Many cases of cerebral palsy usually occur as a result of irregular delivery techniques. These medical errors can cause severe damage to certain parts of the baby’s developing brain as he/she passes through the birth canal. Factors indicating potential danger during prolonged labor can include: the baby being stuck in the birth canal with no oxygen supply; the mother goes into labor and the doctor fails to ensure that the delivery occurs within 24 hours. These labor indicators greatly increase the chance of brain damage to the infant. Brain damage is one of the leading factors in cerebral palsy development.

Another factor that can contribute to birth trauma is if the umbilical cord becomes wrapped around the infants’ neck. The baby under this type of stress, during the birthing process can suffer hypoxia or a lack of oxygen to the brain, which can result in mental retardation or cerebral palsy.

Other known medical errors includes:
  • Failure to recognize and treat seizures following delivery
  • Excessive use of vacuum extraction; improper use of delivery forceps
  • Failure to perform a caesarean section in the presence of fetal distress
  • Failure to plan for a caesarean section in the event of a potentially large birth weight. Failure to respond to the mother’s high blood pressure or toxemia
  • Failure to diagnose and treat jaundice or meningitis
  • Inattentive medical personnel

Medical mistakes are attributable for many birth injury cases and it is usually impossible for the parent to determine if medical negligence caused their child’s injury. It is only through the concerted efforts of a legal and medical team that the cause can be properly ascertained.
