Liquor Liability (Dramshop Liability)

Excessive alcohol consumption often always leads to poor decisions like drinking and driving. When drunk drivers injure innocent people, they must and should be held accountable.

If the driver, however, was over served at the bar or restaurant or at that private event, then that party may also be held liable and accountable for that accident.

To simplify an explanation, as per ‘Wikipedia’ - "Dram Shop liability refers to that body of law governing the liability of taverns, liquor stores and other commercial establishments that serve alcoholic beverages". Such ‘shops’ might also include bars, nightclubs, restaurants and hotels or any such place where alcoholic beverages are sold.

It further explains that "dram shop laws establish the liability of establishments arising out of the sale of alcohol to visibly intoxicated persons or minors who subsequently cause death or injury to third-parties (those not having a relationship to the bar) as a result of alcohol-related car crashes and other accidents".

Essentially, if an establishment sells or serves alcohol to an already visible intoxicated person or even a minor, the server and owner can and should be held liable, especially if that person causes an injury, either to himself or other innocent parties.

If you or someone you know was injured by a drunk driver, you may be able to file a lawsuit not only against the driver but also the dram shop owner /host who served the alcohol.
